Cancellation Refund Agreement

CANCELLATION AND REFUND CONDITIONS FOR DOMESTIC & INTERNATIONAL TOURS, RESERVATIONS, PACKAGES, TOURS, REGISTRATION, AND SALES

I– PAYMENTS

  1. For domestic hotel and tour sales, at least 35% of the reservation amount must be paid at the time of registration, and the remaining balance must be paid within 7 business days from the date of sale. If the tour start date or hotel check-in date is within 7 days, the full tour/hotel amount must be paid at the time of registration. If these payments are not made within the specified periods, the reservation will be canceled, and 35% of the total service fee will be invoiced to the consumer as a cancellation compensation.
  2. For promotional sales (such as early booking discounts and promotional sales), the consumer who purchases a discounted service is required to pay the full price of the service at the time of booking.
  3. For special products and services, the total amount must be paid at least 60 days before the start of the service. If these payments are not made within the specified periods, the reservation will be canceled, and 35% of the total service fee will be invoiced to the consumer as a cancellation compensation.

II- CANCELLATION – WITHDRAWAL – CHANGES

  1. BEAUTY FLIGHTS may cancel the package tour agreement due to the lack of the required number of confirmed bookings and/or force majeure circumstances preventing the trip from starting or continuing. In this case, the consumer will not have any compensation rights. BEAUTY FLIGHTS is obligated to inform participants of the cancellation and refund all fees collected from the consumer within 14 days. Refunds will be processed based on the exchange rate on the payment date. Even if the visa process has been completed, visa fees will not be refunded if the tour is canceled. The responsibility for obtaining visas lies with the consumer purchasing the package tour.
  2. A- In domestic hotel sales, if the consumer cancels the reservation/agreement up to 30 days before the service begins, the full amount of the reservation fee will be refunded, except for the mandatory taxes, fees, and similar legal expenses.

B- In domestic hotel sales, the consumer accepts, declares and undertakes to pay BEAUTY FLIGHTS 35% of the trip price if they cancel the reservation/contract 29-15 days before the start of the service, and the entire amount if they cancel less than 14 days before. Any requests for date changes made by the consumer will be treated as a cancellation, and the date change request must be submitted in writing by the consumer, taking into account the time periods specified in the relevant clauses.

C- For domestic package tours, if the consumer cancels the reservation/agreement up to 30 days before the service begins, the full amount of the reservation fee will be refunded, except for the mandatory taxes, fees, and similar legal expenses. However, if the consumer has obtained a visa, the visa fee will not be refunded. If the consumer cancels the reservation/agreement within 29 days of the tour start date, they agree to pay the full tour fee to BEAUTY FLIGHTS, except for force majeure cases. Any requests for date changes made by the consumer will be treated as a cancellation, and the date change request must be submitted in writing by the consumer, taking into account the time periods specified in the relevant clauses.

For promotional package tour sales (such as early booking discounts or promotional tours), cancellations made for any reason after the booking date will result in the total tour fee being forfeited, with no refunds. Name, date changes, and transfer requests will not be accepted. In this case, the consumer agrees to pay the full tour fee to BEAUTY FLIGHTS as cancellation compensation.

D- In the event that the consumer or a first-degree relative suffers from an illness or death preventing their usual occupation for a period of 10 days, and the consumer submits an official medical board report from a fully equipped state hospital regarding such circumstances, within less than thirty (30) days prior to the commencement of the service, the amount paid by the participant shall be refunded in full without any deductions, except for costs arising from mandatory taxes, fees, and other similar legal obligations, as well as amounts paid to third parties and substantiated by documentation, which are non-refundable. In the event that the consumer, despite exercising due diligence, is unable to foresee or prevent an unforeseen situation or force majeure event, and provided that the consumer submits the relevant documentation pertaining to such situation, in the case of a termination notice given less than thirty (30) days prior to the commencement of the package tour, the amount paid by the consumer shall be refunded within fourteen (14) days, without any deduction, except for costs arising from mandatory taxes, fees, and other similar legal obligations, as well as amounts paid to third parties and duly documented, which are non-refundable.

  1. In the situations described in article 2, consumers’ material damages covered by the insurance will be claimed from the relevant insurance company.
  2. For domestic hotel sales during discount periods (such as early booking campaigns), unless there is a force majeure, no requests for name and date changes, transfers, or cancellations will be accepted. In such cases, the consumer agrees to pay the full reservation fee to BEAUTY FLIGHTS as cancellation compensation.
  3. If the consumer does not notify BEAUTY FLIGHTS in writing that they will participate in the trip after missing its start, BEAUTY FLIGHTS reserves the right to cancel all reservations made on behalf of the consumer 24 hours later. No refunds will be made for such cancellations.
  4. The consumer may transfer the tour package to a third party by notifying BEAUTY FLIGHTS in writing or via a permanent data storage deviceat least 7 days before the start of the service, provided that BEAUTY FLIGHTS gives written consent. The transferee will be responsible for the balance and any additional costs incurred. Transactions related to the transferred tours will be conducted based on the current exchange rate of the system. Visa fees for consumers whose visa process has been completed will not be refunded. Consumers who take over the package tour will be responsible for their own visa procedures. Transfers are not accepted for promotional package tour sales.
  5. Force Majeure: Adverse weather conditions, roadblock, strike, terrorism, war, the possibility of war, and unforeseen technical issues that prevent the start or continuation of the trip shall be considered force majeure by both parties. Illnesses and/or deaths of the passenger or their first-degree relatives that hinder their regular occupation for 10 days, provided that an official report from a fully equipped state hospital is presented, shall also be considered force majeure.
  6. Sales are conducted either in cash or through bank credit cards, either as a lump sum payment or in installments using credit cards that offer installment options. In cases where payment is not made for purchases made via credit card, the consumer is responsible for dealing with the bank with which they have signed a credit card agreement. In such cases, the interest rates applied by the bank shall be valid, and BEAUTY FLIGHTS shall not be a party to the issue.
  7. If, after the execution of the contractual work, the bank or financial institution refuses to pay BEAUTY FLIGHTS the service fee due to allegations that the consumer’s credit card was used unlawfully and without authorization by third parties, the consumer shall be responsible for the disputed service fee and all damages, along with the statutory interest accruing from the reservation date.
  8.  All services included in package tour programs are explicitly stated. Tours or services not included in these are subject to additional charges. During the reservation, two separate receipts will be issued for the tour package fee and additional service fee. These collected amounts also include guide service fees.
  9. BEAUTY FLIGHTS may individually notify each consumer of possible tour cancellations or make a general announcement through a high-circulation newspaper published in Turkey. In this case, the notification obligation shall be deemed fulfilled.
  10. BEAUTY FLIGHTS reserves the right to change hotel names, transportation vehicles, departure times, and departure locations within the scope of the trip, provided that the standards specified in the program are maintained and the consumer is informed. The tour programs provided at registration are sample programs. The dates on which optional tours mentioned in the tour programs will be organized and their prices may vary depending on the number of participants. The consumer accepts that the travel conditions are met as long as the overnight stays within the total travel period are not shortened and no changes are made to the class and category of the accommodation facilities.
  11. If the consumer requests BEAUTY FLIGHTS to handle visa procedures, they must have a passport valid for at least six months and apply to BEAUTY FLIGHTS within the timeframe and with the documents specified by the relevant consulate. BEAUTY FLIGHTS acts as an intermediary between the consumer and the consulate in visa processes and is not responsible for the non-issuance of the visa. If the visa is not approved by the consulate, the cancellation conditions mentioned above shall apply.
  12. The scope of guarantees regarding incomplete or defective performance, damage, loss, and liability for consumers who purchase travel insurance services or have travel insurance included in their package is determined by the policy of the insurance company providing the service. BEAUTY FLIGHTS is not responsible for the content, scope, or application methods of these guarantees.
  13. The price and conditions set forth in BEAUTY FLIGHTS’ package tour agreement cannot be changed. However, this provision does not apply to price changes resulting from exchange rate fluctuations, airport landing fees, and other taxes and charges. If there are extraordinary differences in exchange rates, fuel costs, or port/airport taxes, such differences will be reflected in the contract price, provided that the participant is notified in writing or via a permanent data storage device at least 20 days before the scheduled tour date and that the increase does not exceed 5% of the contract price. Visa fees, mandatory taxes, charges, and similar legal obligations, as well as documented payments made to third parties, and insurance fees, are non-refundable under any circumstances.
  14. BEAUTY FLIGHTS is responsible for any changes occurring after the commencement of the trip purchased by the consumer. In the event of evident changes detrimental to the consumer, BEAUTY FLIGHTS may compensate the consumer during or after the trip in accordance with the provisions of the TÜRSAB KÜTAHYA TABLE by refunding the price or providing services. Alternatively, compensation may be made through additional and/or alternative arrangements provided to the consumer during the trip that were not included in the price. If the consumer accepts and utilizes such additional or replacement services, they forfeit their right to claim a refund or compensation.
  15. If the consumer abandons the tour on the grounds that the service is defective, they must immediately notify the BEAUTY FLIGHTS representative and the hotel they are staying in, along with their reasons, in writing. Otherwise, the consumer will not be deemed to have abandoned the tour and will be considered to have received and used the service. It is the duty of a conscientious consumer to report complaints about the service in writing to the relevant authority during the service period.
  16. The cancellation and refund provisions stipulated in this agreement, agreed upon between BEAUTY FLIGHTS and the consumer at the time of registration, have been read by the consumer. The consumer has been informed about all accommodation details through sources such as brochures, websites, and sales software programs and has signed the agreement accepting the same conditions on behalf of other individuals they have registered to join the same trip. The consumer agrees to pay for any price differences arising from incorrect or incomplete voucher details provided by them.
  17. Consumers participating in the trip who have not personally signed the contract shall be deemed to have accepted and committed to the terms of this contract by authorizing the consumer(s) who registered on their behalf to sign it. However, if these consumers later claim that they did not personally sign the contract and file legal actions against BEAUTY FLIGHTS regarding the trip, BEAUTY FLIGHTS reserves the right to recourse for any additional amounts paid due to such claims from the consumer(s) who signed the contract. Consumers participating in this trip are considered to have learned about and accepted the terms of this contract through catalogs and advertisements, even if they have not signed it personally. The legal obligations are fulfilled when a copy of this contract is issued in the name of the individuals participating in the trip and handed over to the consumer authorized to sign the contract.
  18. BEAUTY FLIGHTS acts as an intermediary between consumers and hotels, transportation companies, and other third-party service providers. Therefore, consumers registering for the trip acknowledge that BEAUTY FLIGHTS is not responsible for any failure to be present at the departure location at the scheduled time, delays, breakdowns, weather conditions such as fog, storms, blizzards, roadblocks, route changes, strikes, terrorism, war risks, or similar force majeure, as well as any failures or damages caused by the personal faults of transportation operators or third parties, unforeseeable technical issues, accidents with material or immaterial damage, or deficiencies in accommodation services.
  19. All arrangements related to charter flights are subject to international aviation regulations. According to the Warsaw Convention, airlines can make any changes to flight times for these flights. Departure times cannot be guaranteed. The carrier may change or cancel the stopover locations indicated on tickets. Since flight times are finalized 48 hours in advance, the times provided at the time of sale are only estimated. BEAUTY FLIGHTS cannot be held responsible for any changes, and therefore, cancellation and refund requests based on such changes will not be accepted.
  20. All services included in the tour programs are explicitly listed. Tours or services not included in these are subject to additional charges. The fees and contents of additional tours are determined and recommended by local agencies in the visited cities or countries. These tours will only take place if sufficient participation is achieved. No compensation and/or refund requests can be made to BEAUTY FLIGHTS due to the cancellation of additional tours.
  21. BEAUTY FLIGHTS is responsible for events occurring after the commencement of the promised service, except in cases of force majeure, situations attributable to the consumer, and personal liabilities of third parties.
  22. For matters not covered in this contract, the provisions of Law No. 1618, Law No. 6502, Law No. 2634, IATA, IHA, UFTAA conventions, civil aviation laws, the Turkish Code of Obligations, the Turkish Commercial Code, the Consumer Protection Law, international agreements to which Turkey is a party, and related regulations, decrees, circulars, and communiqués, as well as the TÜRSAB Kütahya Schedule derived from the internationally recognized Frankfurter Tabelle, shall apply.
